1. About Us

These Terms & Conditions ("Terms") govern your use of the eSIM platform and services operated by Innovative Cards Concepts LLC ("ICC", "we", "us", or "our"), a company incorporated under the laws of the Sultanate of Oman (CR No. 1505957), located at PO Box 386, Postal Code 112, Ruwi, Muscat, Sultanate of Oman.

By accessing or using our platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

2. Eligibility

To use our services, you must:

• Be at least 18 years of age
• Own or use an eSIM-compatible device
• Have the legal capacity to enter into a binding agreement
• Provide accurate and truthful registration information
• Not be prohibited from using our services under applicable law

3. Account Registration

When creating an account, you agree to:

• Provide a valid email address and phone number
• Keep your login credentials secure and confidential
• Notify us immediately of any unauthorized access to your account
• Be responsible for all activity conducted through your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Our Services

ICC operates a platform that allows users to browse, purchase, and activate eSIM data plans and to purchase mobile top-up (airtime/data recharge) for use in supported countries. Our eSIM plans and mobile top-ups are delivered through our network of carrier partners.

eSIM plans:

• eSIMs are digital products delivered electronically to your registered email address and/or dashboard
• You are responsible for verifying that your device is eSIM-compatible and unlocked before purchase
• eSIM plans are destination- and duration-specific — review plan details carefully before purchase
• Activation instructions are provided upon purchase — follow them carefully
• Some plans have expiry dates — unused data after expiry is non-refundable
• eSIMs are for data use unless otherwise stated; voice and SMS may not be supported on all plans

Mobile top-up:

• Mobile top-up (recharge) is applied to the phone number you provide at checkout
• Delivery is typically within minutes; timing depends on the destination operator
• You are responsible for entering the correct country and phone number
• Mobile top-up purchases are final once the transaction is submitted — no refunds

We reserve the right to modify, suspend, or discontinue any plan or service at any time with reasonable notice.

5. Device Compatibility

It is your responsibility to ensure your device is:

• eSIM-compatible (supports eSIM technology)
• Network-unlocked (not locked to a specific carrier)
• Running a supported operating system version

ICC is not liable for purchases made on incompatible or locked devices. No refunds are issued for device incompatibility.

6. Payments

• All payments are processed securely through Stripe, a PCI-DSS compliant payment processor
• By making a payment, you agree to Stripe's Terms of Service
• Prices are displayed in the applicable currency and include applicable taxes unless otherwise stated
• You are responsible for ensuring sufficient funds or credit are available for your transaction
• ICC does not store your payment card details

7. Refund Policy — All Sales Final

No refunds are offered for eSIM or mobile top-up purchases except as required by law.

• eSIM: Once an eSIM is delivered (email or dashboard), it is considered delivered. No refunds after delivery. If you have not activated the eSIM and believe you have a technical fault that prevents activation, contact support — we may, at our discretion, offer a replacement only where the fault is on our side.
• Mobile top-up: Mobile top-up (recharge) is non-refundable. Once the top-up is submitted to the operator, the transaction cannot be reversed. Ensure the phone number and country are correct before payment.
• Expired plans: Unused data from expired eSIM plans is non-refundable.
• Device compatibility: Refunds are not issued for device incompatibility. Verify your device supports eSIM before purchase.

8. eSIM Activation and Use

• eSIM QR codes and activation details are sent to your registered email address
• Do not share your QR code — each QR code can only be activated once
• ICC is not responsible for eSIM codes that are lost, stolen, or shared by the user
• Data speeds and availability depend on local network conditions and carrier agreements — we cannot guarantee specific speeds
• Fair use policies of the underlying carrier may apply to unlimited plans

9. Acceptable Use

You agree to use our services only for lawful purposes. You must not:

• Resell or redistribute eSIM plans without our written consent
• Use our platform for fraudulent or deceptive activities
• Attempt to gain unauthorized access to our systems
• Use automated tools or bots to interact with our platform
• Violate any applicable local, national, or international law

We reserve the right to suspend or permanently ban accounts that violate this section.

10. Intellectual Property

All content, trademarks, logos, and materials on our platform are the exclusive property of ICC or our licensors. You may not reproduce, distribute, or create derivative works without our prior written consent.

11. Privacy

Your use of our services is governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review it carefully.

12. Disclaimer of Warranties

Our services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:

• Uninterrupted, error-free, or secure operation
• Guaranteed data speeds or network coverage in any specific area
• Compatibility with all devices

13. Limitation of Liability

To the maximum extent permitted by applicable law, ICC shall not be liable for any indirect, incidental, consequential, or punitive damages arising from:

• Your use of or inability to use our services
• Network outages or coverage issues outside our control
• Device incompatibility with eSIM technology
• Unauthorized access to your account

Our total liability for any claim shall not exceed the amount you paid for the specific eSIM plan giving rise to the claim.

14. Indemnification

You agree to indemnify and hold harmless ICC, its officers, employees, and partners from any claims, losses, or expenses arising from:

• Your violation of these Terms
• Your misuse of our services or eSIM plans
• Your violation of any third-party rights

15. Modifications to Terms

We may update these Terms at any time. We will notify you of material changes via email or platform notice. Your continued use of our services after such notice constitutes your acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by and construed in accordance with the laws of the Sultanate of Oman. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Muscat, Oman.
